These Terms of Service ("Terms") govern your access to and use of QAShip, the test case management platform available at qaship.com, including all related features, tools, and services (together, the "Service"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation, and "you" refers to that organisation.
If you do not agree to these Terms, you must not use the Service.
QAShip provides tools for writing, organising, and executing software test cases, tracking test runs and results, and collaborating with your team. We may add, change, or remove features at any time as the Service evolves.
To use the Service you must create an account, either with an email address and password or through a supported identity provider (such as Google or Microsoft). You must provide accurate information and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorised use of your account.
You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.
The Service is organised around workspaces owned by an organisation. If you join an organisation's workspace, the organisation's administrators can manage your access, view content you create in that workspace, and remove you from it. Content created within an organisation's workspace belongs to that organisation, subject to Section 6.
You agree not to misuse the Service. In particular, you must not: (a) use the Service in violation of any applicable law or regulation; (b) attempt to gain unauthorised access to the Service, other accounts, or other organisations' data; (c) probe, scan, or test the vulnerability of the Service without our prior written consent; (d) interfere with or disrupt the integrity or performance of the Service; (e) upload malicious code or content that infringes any third party's rights; (f) resell, sublicense, or provide the Service to third parties as a competing offering; or (g) use automated means to access the Service other than through interfaces we provide for that purpose.
You (or your organisation) retain all rights to the content you submit to the Service, including test cases, test runs, results, comments, and attachments ("Customer Content"). You grant us a worldwide, non-exclusive licence to host, store, process, transmit, and display Customer Content solely as necessary to provide, maintain, and improve the Service and as otherwise permitted by these Terms.
You are responsible for Customer Content and must have all rights necessary to submit it. We may remove content that violates these Terms or applicable law.
The Service integrates with third-party products such as Jira and identity providers such as Google and Microsoft. Your use of a third-party service is governed by that provider's own terms and privacy policy, and we are not responsible for third-party services. Enabling an integration authorises us to exchange relevant data with that service on your behalf.
The Service includes optional AI-assisted features. Output generated by AI features is provided for convenience, may be inaccurate or incomplete, and should be reviewed before you rely on it. AI features may be subject to usage limits, which we may adjust from time to time.
The Service, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited right to use the Service in accordance with these Terms, no rights in the Service are granted to you. Any feedback you provide about the Service may be used by us without restriction or obligation to you.
The Service is currently offered free of charge. We may introduce paid plans or fees for some or all features in the future. If we do, we will give you reasonable advance notice, and continued use of the affected features after fees take effect will require you to accept the applicable pricing terms.
We aim to keep the Service available at all times but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or events beyond our reasonable control. We recommend exporting important data regularly using the export tools provided.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT DATA WILL NOT BE LOST.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE AND ONE HUNDRED POUNDS STERLING (£100).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if we discontinue the Service (in which case we will give reasonable notice where practicable). Upon termination, your right to use the Service ceases; provisions that by their nature should survive termination (including Sections 6, 9, 12, 13, and 16) will survive.
We may update these Terms from time to time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. The "Last updated" date at the top of this page indicates when these Terms were last revised.
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or the Service, except where the law of your country of residence grants you mandatory rights to bring proceedings elsewhere.
